PART 1: PRIVACY POLICY (AVG/GDPR)

1. INTRODUCTION All Day Athletes B.V. (“ADA”, “we”, “us”) respects your privacy and is committed to protecting your personal data. This policy outlines how we collect, use, and safeguard your information in compliance with the General Data Protection Regulation (AVG) and Dutch law.

3. DATA WE COLLECT To provide elite training and administrative services, we collect the following data:

  • Identity Data: Name, date of birth, gender.

  • Contact Data: Email address, phone number, billing address.

  • Performance & Health Data: Height, weight, injury history, and physical test results (strictly for training optimisation purposes).

  • Visual Data: Photos and video footage taken during training sessions or events.

  • Usage Data: Information on how you use our website (cookies, IP address).

4. PURPOSE OF PROCESSING We process your data for the following purposes:

  • To organise and execute training programs and events.

  • To communicate regarding schedules, payments, and program updates.

  • To analyse athlete performance and tailor training regimens.

  • To create marketing content (social media, website) that promotes the academy.

  • To comply with legal obligations (e.g., tax records).

5. MEDIA & CONTENT By participating in ADA programs, you acknowledge that training sessions may be filmed or photographed. ADA uses this content for performance analysis and marketing/promotion. If you strictly object to your image being used for marketing, please notify us in writing prior to the start of your program.

 

6. DATA RETENTION We retain personal data only as long as necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. Inactive athlete profiles are reviewed and anonymised or deleted after 3 years of inactivity.

 

7. YOUR RIGHTS Under the AVG, you have the right to:

  • Request access to your personal data.

  • Request correction of inaccurate data.

  • Request deletion of your data (“Right to be forgotten”).

  • Object to the processing of your data.

PART 2: TERMS & CONDITIONS (ALGEMENE VOORWAARDEN)

1. APPLICABILITY These General Terms and Conditions apply to all offers, agreements, and activities (including training sessions, camps, clinics, and consultancy) provided by All Day Athletes B.V.

 

2. REGISTRATION & PAYMENT

  • Participation in ADA programs is only guaranteed upon full payment or a signed agreement.

  • For “Application Only” programs (e.g., Summer Protocol), acceptance is at the sole discretion of ADA staff based on skill level.

  • Payment is due immediately upon invoicing unless otherwise agreed in writing. Failure to pay may result in exclusion from training.

3. CANCELLATION POLICY

  • By the Athlete:

    • Cancellations made more than 30 days before the start date: 100% refund (minus administrative fees).

    • Cancellations made 14–30 days before start date: 50% refund.

    • Cancellations made less than 14 days before start date: No refund.

  • By ADA: In the event ADA must cancel a session (e.g., facility issues), we will offer a makeup session or a pro-rated refund. ADA is not liable for travel or accommodation costs incurred by the athlete.

4. LIABILITY & WAIVER (IMPORTANT)

  • Risk: Basketball is a high-intensity contact sport. Participation involves inherent risks of physical injury. The athlete (or their legal guardian) voluntarily assumes all risks associated with participation.

  • Waiver: All Day Athletes B.V., its owners, employees, and contractors are not liable for any personal injury, disability, death, or property damage/theft sustained during activities, except in cases of proven gross negligence or willful misconduct by ADA.

  • Medical Fitness: The athlete declares they are physically fit to participate in high-performance training. It is the athlete’s responsibility to inform staff of any medical conditions or past injuries prior to the session.

5. CODE OF CONDUCT ADA maintains a professional, elite environment. We reserve the right to dismiss any athlete from the program—without refund—for:

  • Disrespectful behaviour towards staff or other players.

  • Vandalism or theft of property.

  • Failure to adhere to the training schedule or instructions.

6. INTELLECTUAL PROPERTY All training methodologies, drills, and “blueprints” provided by ADA are the intellectual property of All Day Athletes B.V. Sharing these proprietary materials with third parties without permission is prohibited.

 

7. GOVERNING LAW These terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Amsterdam.
